| REGULATIONS ON LENDING AND USING OF PHOTOS AND DIGITAL DATA | |
| 1. | Lending photos and data for your examination is within two weeks. Selected photos are available within two months counting form the date of issue. Please use them within two weeks of lending period only after informing us of your decision on use to get our approval. |
| 2. | The unit of the rental charge for copyright is applied for one sponsor, one purpose and one opportunity per one photo. Soon after examining and using, please remember to inform us of disposing the data without fail. Transferring, selling and copying without permission are strictly prohibited. When use without permission and use of outflow photos and data by a third person is discovered,charge for compensation more than ten times as much as regulations is requested to the first user and illegal ones. |
| 3. | We do not hold several rights such as a right of portrait, a trademark right, a patent, a copyright on figures, objects, architecture, places as subjects of photos.
(They are not included in the rental charge for copyright.)
Please remember that permission is necessary to these rights in some cases.
We do not bear responsibility if any trouble or damage occurs on illegal use.
According to the contents of use such as an extravagant advertisement,lending may be refused. The photos and data are not monopoly so that the same or similar ones may have used already or will be used in the future by other customers. |
| 4. | Please do not take the frame out, duplicate or print before informing us of your decision on use to get permission, otherwise the same amount of the rental charge for copyright will be requested. Opening the photos and data without permission will be charged for presentation regardless of your use. A low resolution data is for examination. Use for presentation will be charged as shown in the price list. |
| 5. | In case you duplicated or printed photos after your decision on use is defined, please remember to offer them together with the took out frame and original ones. |
| 6. | Please avoid anything as to damage original photos such as by writing in with white paint or heating. |
| 7. | As to using photos, please remember to give credit as below. photo:photographer/Gears-Factory |
| 8. | Extending the period on loan will be charged 100 yen a day per one photo for arrears shown in the price list. In case the photos on loan is not returned after passing six months counting from the date of issue, the charge in compensation for the loss will be requested. |
| 9. | To return the photos by mail, please be careful not to be bent or get wet and send it registered without fail. In case any accidents such as damage, corruption, loss of photos are occurred in transit, the expenses are for you to bear. As to loss and unretouchable damage, we charge more than 180,000 yen per one original photo and to other damages more than 80,000 yen each for compensation. |
| 10. | Please send two of the magazines which is printed our photos for our data. |
| 11. | Any lawsuit or dispute as to regulations on lending and using photos based on this agreement is due to hold a court in a law court within the jurisdiction of the site of our agent. |
| We expect you to continue making a deal with us under confirming the regulations as stated above. | |
